| Contract : |

Tours in this site are operated by Shree Yash Destinations Pvt. Ltd. hereafter to be referred as Yash Destinations.
When a booking is made, it constitutes a contract between You and Yash Destinations. All booking are taken understanding that You accept these terms and conditions. Yash Destinations organizes services like hotel accommodation, transfers, sightseeing tours and cruise bookings. We being travel organizers only, We do not control or Operate any Airline, neither do we own or control or operate any shipping company, coach company, hotel, transport or any other service mentioned in this brochure. Though we take care in selecting all the necessary agencies for your vacation, we have no control in running them. Hence we cannot be held responsible for any injury, death, loss or damage, or deficiency in services which is caused by the act or default of management or employees of an independent contractor arising outside our normal selection and inspection process. (The contract and the Disputes, if any will be subject to Mumbai Jurisdiction only)

| Booking and Payment : |
|
A non refundable and interest free deposit of INR 25,000/- is paid at the time of registration. (Full payment for Joining the Rocky Mountainner is required to be paid by the passenger at the time of booking). The balance amount should be made payable 60 days from the commencement of the tour. If the balance amount is not paid within 60days the tour stands automatically cancelled and the amount non-refundable. The registration amount is non-adjustable against any other tour or service.

| Change of Pricing : |
|
Though all efforts would be made to maintain the cost given, Price structure may change in event of a change in government policies, change in the Tax Structure or Fuel Hike or any hike which may come in effect with 01 Jan. 2007. This difference would have to be borne by the passenger.

| Accommodation : |
|
Tours and Packages listed in the brochure have according to the price range budget to deluxe category hotels. All rooms provided will have private bath and shower facility Hotels specified in the itinerary, if not available a similar category hotel would be provided.

| Liability : |
|
Yash Destinations is not liable or responsible for any damages, loss, injury accident, death, delay, breakdown or irregularity that may occur in carrying out the tour arrangement. (In event of a passenger falling Ill or suffering any accident during the journey, all hospital expenses, doctor fees, repatriation expenses, and other charges incurred as a direct or indirect result of his / her illness / accident are the responsibility of the passenger. (Management reserves the right to claim any additional expenses due to delay or changes in train, air plane, bus ship or other services, weather conditions, strikes, war, quarantine or any other cause whatsoever all such loss or expenses must be borne by the passenger.

| Cancellation and Refund : |
|
In event that a tour participant cancels, his / her booking, the following fees / charges would be levied. Transfer from one tour to the other can however be done 60days prior to the commencement of the tour only. All cancellation / amendment to be received in writing and signed by the tour participant.
No refund would be payable for partially utilized air tickets or ground arrangements.
However a refund for ground services not utilized would be payable if the service has been cancelled due to natural conditions like weather or technical challenges, whereby a letter from the agency concerned has to be produces stating the reason for cancellation. Settlement of refunds will be done only thru the office where the tour / package has been booked. The refund amount will be paid in Cheque only. No refunds can be claimed overseas. The company is not responsible for any passengers that are denied boarding inspite holding a confirmed reservation that may result in cancellation/re-booking of his tour arrangements / travel plans.

Tours mentioned hereunder are subject to RBI / GOI approval.

Shree Yash Destinations Pvt. Ltd., reserves the right to alter Timings & Itineraries or cancel any tour. In both
the cases, the company shall not be liable for any damage/loss/expence suffered to the passengers.

|
No separate bed would be provided to children below 12 years of age.
|
|
Although care has been taken to accommodate passengers at the hotels mentioned in the itineraries, the same
may be altered to a similar category.
|
|
The company shall not be liable for any damage/loss accrued due to acts or negligence of any carrier, hotel,
coach company or attraction.
|
|
Complaints if any must reach the office not later than 30 days after the completion of the tour else the same
will not be entertained.
|
|
The company exercises the right to withdraw or alter any promotions it has advertised . In such case the
company is not liable to pay any compensation.
|
|
For a group of less than 15 passengers the sightseeing will be done on Seat in Coach basis.
|
|
Meals unless specified are not included in the tour cost. Meals where provided are pre-set meals and the menu
choice not available.
|
|
No refunds would be entertained due to Visa refusal.
|
|
The information provided in this brochure is extracted from travel magazines and to the best of our knowledge
accurate.

The tour cost mentioned are in USD or in CAD & are Payable as per the rate of exchange as of date.
The amount shall be taken as a part of the passengers Basic Travel Quota or as per RBI guidelines.
